PRIVACY POLICY

Thank you for visiting one of our sites, which may include https://www.futurestage.live/, https://hub.futurestage.live) (the “Site”) or using our mobile applications (each, an “App”) (collectively, the “Services”). This Site and STAGE.KIT app are operated by Evil Eye Pictures LLC (“EEP,” “we,” “our” or “us”). Your use of the Services is subject to this Privacy Policy.  

STAGE.KIT is an iOS app that is used by Actors, Directors and Monitors to perform together live in a video conference like setting.

This Privacy Policy provides information regarding how we collect and process your personal information via your use of the Services only; it does not apply to information collected off the Services.  When we refer to “personal information” in this Privacy Policy, we mean information that directly or indirectly identifies you or can be used to identify you as an individual.  This Privacy Policy does not apply to aggregated, de-identified or anonymous data.  Your personal information will be processed in accordance with this Privacy Policy.

We recommend that you periodically review the Privacy Policy. If you do not agree with any provision of this Privacy Policy, do not use the Services.

Information You Provide to Us; Information Provided On Your Behalf.  We will collect personal information from you if you voluntarily provide it through the Services, such as by providing your name, business contact information, and email address.  You may be asked to provide this information depending on how you use the Services, such as if you wish to send us a message, use our contact us form, or create an account on the Services.  We will collect personal information if a Services user obtains a license for you to use the Services.  If you provide us with personal information of another person, you warrant that you have all necessary permissions to provide us with such information and for us to use such information in accordance with this Privacy Policy. 


Information You Provide Via an App.  If you use one of our Apps, we may also collect and capture your facial position and rotation, eye rotations, blendshape coefficients (for more information see this ARKit Documentation), and RGB color image for low resolution reference purposes, all via the iOS TrueDepth API, or microphone audio recordings, depending on how you use the App.  If you are using the App but are not connected to an active show, then live facial position and rotation data is applied to an in-app preview of your digital avatar, but we are not recording or collecting that information.  If you are using the App and connected to an active show running on STAGE.HUB (our cloud platform), then you will be notified when your managing member activates a recording and you can see via the App that a recording has commenced.  We only capture facial and/or audio data after the recording has commenced.  The App will notify you when the recording feature is in use.  Facial and audio data is recorded in your organization’s personal storage area on STAGE.HUB cloud servers.  Facial and audio data is not recorded or stored locally on your iOS device.  An optional Calibration feature is available in the App. Calibration captures a series of ARKit blendshape coefficients and location offsets to help center your head on screen and create a neutral pose for your digital avatar. Calibration data is only stored locally on your phone and is not transmitted to STAGE.HUB cloud servers. Calibration data is comprised solely of mathematical offsets derived from your head and facial position and does not include identifying visual or biometric data. Local calibration data can be deleted by you in the STAGE.KIT App, at any time, without restriction. Before the App can receive facial position information or microphone audio, the App will request your permission to access your device’s camera and microphone.  If you do not grant permission, then this functionality will not be available.  You have the option to update your settings to share or stop sharing audio or video from your iOS device with the App.  See more information below in Section V. about how to update your settings.

Information We Collect AutomaticallyWe will collect information automatically when you use the Services, subject to your browser, mobile application settings and other usage settings.  In general, we automatically gather certain technical information from Services visitors through our automatic data collection tools, including server logs, which may collect certain standard information that your browser sends to the Site such as the number and frequency of your visits.  This information may include the URL of the last and next website you visit, your browser and operating system, device type and operating system, device settings, application IDs, unique device identifiers, your Internet Protocol (“IP”) address, your mobile ID, how long you spend on the Services, and what pages you view on the Services.  We may use this information to understand better how our visitors use the Site and the Services; to improve the Site and the Services; and to protect the Site and the Services.  We may also use this information for crash reporting, traffic analysis, or auditing use of our services.  

When you visit the Site, we may place a “cookie” or other online tracking device (e.g., web beacons).  We use cookies to determine how you use the Site and for analysis of the performance of the Site.  To find out more about cookies, including how to see what cookies have been set and how to manage and delete them, please visit www.allaboutcookies.org.

Web browsers often allow you to erase existing cookies from your hard drive, block the use of cookies, and/or be notified when cookies are encountered. If you elect to block cookies, please note that you may not be able to take full advantage of the features and functions of the Site.

App Permissions.  If you use one of our Apps, you have the option to grant permissions or update permissions at any time.  You can update via the iPhone settings for the App. 

 App Calibration Data.  If you use the optional calibration feature in one of our Apps, you have the option to store, update or delete your calibration data in the App.  

Opting Out of Cookies and Tracking Technologies. The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Without cookies, you may not have access to certain features on the Site

California Shine the Light. Pursuant to California Civil Code §1798.83, California residents with whom we have a business relationship can request information about the types of personal information, if any, we shared with third parties for the direct marketing purposes of the third parties and the identities of the third parties with whom we shared such information in the last twelve (12) months.  We do not share your personal information with third parties in this manner and have not done so in the last twelve (12) months.  You may request more information by contacting us using the contact information at the bottom of this Privacy Policy.

Reviewing Your Information, Updating or Deleting Your Information. You can see the information we have associated with your account by logging in and viewing the account dashboard and file logs.  You can update your information by logging into your account and making applicable updates.  You have the option to delete your account via the Site; you can navigate to the Site via the App if you are using the App.  When you delete your account your information and information associated with your account will also be deleted.  This process may take up to 30 days to complete in accordance with our data archiving and deletion policies.  If you have any questions regarding your account and your choices regarding your account, you can contact us using the contact information listed at the end of the Privacy Policy.

When you participate in an active show running on STAGE.HUB, You specifically consent that:  the App may collect, capture, possess, store, or obtain your image, and data obtained or created from Your image (including the automated recognition of various facial landmarks), and/or audio recordings that might qualify as biometric data, biometric information, or a biometric identifier under various laws. This information will be shared with the organization who provided you access to the App or with anyone you choose to share it with.  You understand that we (including our service providers) may store this information for so long as the organization or account holder chooses to keep the information in the storage area on STAGE.HUB.  Please contact the organization to understand more about how the data may be retained or shared outside of the organization’s personal storage area on the servers; we are not involved in such retention or sharing.  Facial and audio data is not recorded or stored locally on your iOS device.  Please review local laws and regulations regarding biometric data before using the App to capture images or audio of third parties.
